Jonas Software reserves the right, at its sole discretion, to pursue all of its legal remedies and to remove the Applicant’s user content from the Website upon any breach, or suspicion of breach by Applicant of these Terms or if Jonas Software is unable to verify or authenticate any information submitted by Applicant on the Website.

Suspension Or Withdrawal Of The Website

10. The Website is made available to Applicant free of charge.
11. Jonas Software does not guarantee that the Website, or any content on it, will always be available on an uninterrupted basis.
12. Jonas Software may suspend or withdraw or restrict the availability of all or any part of the Website for business and operational reasons and may do so without providing notice.
13. The Applicant is responsible for ensuring that all persons who access the Website through the Applicant’s internet connection are aware of these Terms and other applicable terms and conditions, and that they agree to be bound by them.

Applicant’s Account

14. Jonas Software takes reasonable measures in accordance with the generally accepted industry practices to provide a secure Website for Applicants by including password authentication to access, complete, and submit an application for employment opportunities at Jonas Software (“Application”).
15. The Applicant will select a user identification code, password or any other piece of information as part of the Jonas Software security procedures, the Applicant must treat such information as confidential. The Applicant must not disclose it to any third party.
16. If the Applicant knows or suspects that its Applicant’s user identification code or password has become known to any person, the Applicant must promptly notify Jonas Software.
17. Jonas Software reserves the right to disable any user identification code or password, at any time, should Jonas Software determine in its reasonable opinion that the Applicant has failed to comply with any provisions of these Terms.

Employment Applications

18. The Applicant acknowledges and agrees that any Application does not constitute, under any circumstances, any form of representation or guarantee an offer of employment by Jonas Software to the Applicant.
19. The Applicant represents and warrants that all the information and statements contained in any Application related to him/her or in any document submitted in connection with or related to such Application to Jonas Software are accurate, compete and up to date.  At any time, Jonas Software reserves the right to verify any and all information contained in an Application provided by Applicant during the recruitment process.
20. The Applicant acknowledges and agrees that any false, misleading, inaccurate, or incomplete statement (including any omission of relevant fact), in whole or in part in such Application documents or otherwise during the recruiting process may, at Jonas Software’s sole discretion, disqualify the Applicant from receiving an offer of employment or being considered for future employment opportunities with Jonas Software. In such circumstances, Jonas Software may also, at its sole discretion, revoke or withdraw any conditional offer of employment, if applicable.
21. The Applicant acknowledges and agrees that any offer of employment will be conditional on the Applicant possessing and maintaining a lawful right to work for Jonas Software in the location of the role they have applied for. Where so permitted by law, the Applicant will provide satisfactory proof of work authorisation or permit as required by Jonas Software.
22. The Applicant acknowledges and agrees that an offer of employment will be conditional on agreeing and complying with Jonas Software’s corporate rules, procedures and policies, including confidentiality, anti-bribery and data protection policies, which will be provided to the Applicant prior to commencing employment with Jonas Software.
23. Jonas Software is committed to maintaining an inclusive work environment comprised of individuals with diverse perspectives, backgrounds, identities, and cultures. Jonas Software provides reasonable adjustments for Applicants with disabilities during the recruitment process in accordance with applicable laws. The Applicant acknowledges that if reasonable adjustments are required in either the application or recruitment process, an Application must bring such request to the attention of the Jonas Software Human Resources Department at [e-mail].
24. Where applicable and permitted by law, the Applicant understands that references, disclosure, and authorisation forms regarding background checks may be provided, which may constitute a condition of employment. The Applicant authorises Jonas Software to investigate all references provided by an Application during the recruitment process.
25. Jonas Software wishes to thank all applicants for their interest. However, please note that only those candidates selected for further screening or an interview will be contacted.

Personal Data

26. The Applicant acknowledges and agrees that an Application and any personal information provided therein for potential employment with Jonas Software may be held and processed for the purposes of Jonas Software’s recruitment process and, if applicable, any subsequent screening or interview process or employment.
27. By accepting these Terms, the Applicant consents to the transfer of such Application and all personal information contained therein between Jonas Software and/or any third party service providers processing personal information on behalf of Jonas Software. In the event that the relevant Jonas Software affiliate or division or third party service providers are located in a foreign jurisdiction, each will be bound by the laws of the jurisdiction in which they are located and they may disclose personal information in accordance with those laws.
28. Jonas Software shall at all times comply with all relevant data protection legislation.

Applicant’s Obligations  

29. When uploading documents or information on the Website, the Applicant is solely responsible for securing and backing up the related content.
30. The Applicant shall not to attempt to reverse engineer or to circumvent the security measures of the Website, use the Website for anything other than the intended purpose of submitting an Application, and to interfere with the access and use of the Website.

Intellectual Property Rights

31. Jonas Software is the owner or the licensee of all intellectual property rights in the Website, and in the material published on it. Those works are protected by international copyright laws and treaties. All such rights are reserved. The Applicant must not use any part of the content on the Website for commercial purposes without obtaining a license to do so from Jonas Software or our licensors.
32. The Applicant may print off and may download extracts, of any page(s) from the Website for the Applicant’s personal use.
33. The Applicant must not modify the paper or digital copies of any materials that the Applicant has printed off or downloaded in any way, and the Applicant must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
34. If the Applicant prints off, copies or downloads any part of the Website in breach of these Terms, the Applicant’s right to use the Website will cease immediately and the Applicant must, at Jonas Software’s option, return or destroy any copies of the materials you have made.

Disclaimers

35. To the fullest extent permitted by law, Jonas Software does not warrant that the Website will operate error-free or that its servers are free of computer bugs or viruses or other harmful mechanisms. The Website and content are provided on an “as is” basis without any warranties whatsoever. Jonas Software disclaims all warranties, whether express or implied, including the warranty of merchantability, fitness for a particular purpose, and non-infringement. Jonas Software makes no warranties or representations about the accuracy, reliability, completeness, or timeliness of its content, services, or software.
36. The Applicant is responsible for configuring their information technology, computer programmes and platform in order to access the Website. The Applicant should use his/her own virus protection software.
37. The Applicant must not misuse the Website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. The Applicant must not attempt to gain unauthorised access to the Website, the server on which the Website is stored or any server, computer or database connected to the Website. The Applicant must not attack our site via a denial-of-service attack or a distributed denial-of service attackJonas Software will report any such breach to the relevant law enforcement authorities and will co-operate with those authorities by disclosing the Applicant’s identity to them. In the event of such a breach, the Applicant’s right to use the Website will cease immediately.
38. Where the Website contains links to other sites and resources provided by third parties, these links are provided for the Applicant’s information only. Jonas Software has no control over the contents of those sites and resources and such links should not be interpreted as approval by Jonas Software of those linked websites or information the Applicant may obtain from them. 

Limitation Of Liability

39. Jonas Software only provides the Website for domestic and private use, The Applicant agrees not to use the Website for any commercial or business purposes and Jonas Software will have no liability to the Applicant for any loss of profit, loss of business, business interruption or loss of opportunity.
40. Jonas Software will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack or other technologically harmful material that may infect the Applicant’s computer equipment, computer programs, data or other proprietary material due to the Applicant’s use of the Website or to the Applicant’s downloading of any content on it, or any website linked to it.
41. To the fullest extent permitted by law, Jonas Software’s liability arising out of or in connection with the use of the Website, regardless of the cause of action (whether in contract, tort, breach of warranty or otherwise) will in no event exceed $100.

The Applicant agrees to defend, indemnify, and hold harmless Jonas Software, its affiliates, and their respective officers, directors, employees, and agents, from and against any claims, actions or demands, including without limitation, reasonable legal and accounting fees alleging or resulting from the Applicant’s use of the Website or uploading of any content to the Website.

Governing Law

These Terms, their subject matter and their formation, and any disputes or claims arising out of or in connection with those Terms (whether contractual or non-contractual in nature such as claims in tort, from breach of statute or regulation or otherwise) shall be governed by, and construed in accordance with, the laws of Australia and New Zealand.
